1.1 This Data Privacy Statement applies to data we collect  about you on the

  • entering,  processing and performing of contractual relationships

1.3 The data is collected and processed by TANOS and its affiliated companies [in particular  TTS Tooltechnic Systems AG & Co. KG and the companies mentioned at http://subsidiaries.festool.com] and is used only for the fulfilment of the  respective business purpose. The data will only be passed on to third parties  if this is necessary for the fulfilment of the respective business purpose.

2. How is  your personal data processed?  
 
2.1 General  information on the purposes of processing 
We basically only  collect, store and process your personal data in order to fulfil a contractual  obligation towards you or if you have given us your consent. However, we also  use your data to comply with procedures and/or legal provisions that affect us,  insofar as this is necessary to protect our own interests or the legitimate  interests of others or to assert, protect or exercise our rights or defend  ourselves against claims.
 
2.2 Data, which you share with us
2.2.1:  You can normally use our website without directly  providing us with personal information. For some services, such as our  newsletter service or the online shop, we will request personal information  from you.
This includes, among  other things, your name or your e-mail address in order to process the respective  service quickly and in a user-friendly way or to be able to offer the service  at all. Detailed information on all services offered on our homepage can be  found below under point 3 of this data protection declaration.
 
2.2.2: The collection  and processing of personal data is particularly necessary for entering into,  processing and handling contractual relationships, so that we can fulfil our  contractual obligations. This includes your first and last name, your address  and e-mail address as well as a telephone number. You can find out more about  this in the supplementary information.

2.3 Data  that we automatically receive through your use of our online services


Some data is already generated when you visit our  homepage.

2.3.1  Log data
The automatically generated  data includes the log data of the web server. We activate this logging only to  ensure stability and security and, in exceptional cases, to investigate support  cases (legal basis Art. 6 para. 1 lit f GDPR). Each data record consists of:
     
  • Date  and time of the request
  • Client  and server IP address, port and protocol status
  • The  name of the called file or page and the length of the request
  • Login  information for the appropriate web service, if you log in with a user account
  • Browser  type and referrer (last called page of the client)
This data is evaluated anonymously for technical  purposes only. Statistical evaluations are not performed.

2.3.2  Cookies
Cookies are small files  that contain a string of characters in which certain information is stored in  an open or encrypted form. Cookies are sent from the server to your computer  and stored there. They are first used to identify the computer from which a website  has been accessed. If you log on to a website, cookies are used to notify the  server that you are logged on and to check the authorisations to access the  page. Each cookie has an expiration date from which it is no longer valid.  Cookies allow the path of a user to be tracked across different pages of the  homepage and also across different websites. With the help of cookies,  communication between our server and your computer can be improved and thus the  use of a website can be made more comfortable. The legal basis is Art. 6 para.  1 letter f GDPR. Cookies may not only originate from the operator of the  website, but also from third party providers. Most of the cookies we use are  so-called “session cookies”. They are automatically deleted at the end of your  visit. Other cookies remain stored on your device until you delete them. These  cookies enable us to recognise your browser the next time you visit our  website. You have the option of using your browser to display the cookies  present on your computer, to delete the existing cookies or to set up the  configuration in such a way that not all or no more cookies are stored. Please  note that some functions do not work or do not work properly if you deactivate  the setting of cookies.
 
2.3.3  Analysis  of website use

2.3.3.1  Google Analytics
This website uses  Google Analytics, a web analysis service of Google Inc. (1600 Amphitheatre  Parkway, Mountain View, CA 94043, USA),   Google in short. Google Analytics uses text files, so-called cookies.  The cookies are stored on your computer and generate information about your use  of our website.
This information is  transmitted to a Google server in the USA for storage. IP anonymisation is  activated on this website, i.e. your IP address will  be shortened by Google within Member States  of the European Union or in other signatory states to the Agreement on the  European Economic Area before being transmitted. The full IP address is only  transmitted to a Google server in the USA in exceptional cases and shortened  there. For the exceptional cases in which personal data is transferred to the  USA, Google has submitted to the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US-Framework.  The legal basis for the use of Google Analytics is Art. 6 para. 1 sentence 1  lit. f GDPR.
Google uses the  information generated to use this information for TANOS evaluations and reports  on the use and activities on the website and to provide other services for  TANOS in connection with the use of the website and the Internet. These are in  particular functions to display advertisement, such as Google Analytics reports  on performance by demographic characteristics and interests. Google's  demographic and interest performance analytics reports use information and  visitor data from third parties (such as age, gender and interests) obtained  through interest-based advertising by Google. Google will also transmit this  information to third parties, if applicable, provided that this is required by  law or if third parties process this data on behalf of Google.
The IP address  transmitted by your browser in the context of Google Analytics is not merged  with other Google data. You can prevent the use and storage of cookies by  adjusting your browser software accordingly. However, we expressly point out  that in this case you may not be able to use all functions of this website to  their full extent.

2.3.4  Remarketing

2.3.4.1  Google Tag Manager
This website uses the  Google Tag Manager of Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA  94043, USA). Google Tag Manager is used to manage website tags (identifiers)  through an interface. The legal basis for the processing of your data is Art. 6  para. 1 sentence 1 lit. f GDPR. By using the Google Tag Manager, no cookies are  set and no personal data is collected. The tool triggers other tags, which in  turn may collect data. Google Tag Manager does not access this data. If  deactivation has been made at the domain or cookie level, it will remain in  effect for all tracking tags implemented with Google Tag Manager.

2.3.4.2  Google  AdWords and Google Analytics Remarketing
This website uses the  function of Google Analytics in connection with Google AdWords Remarketing of  Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) The  Google AdWords remarketing technology enables us to reach users who have  already visited our website and are interested in our offer through targeted  advertising on the pages of the Google Partner Network. For this purpose, a  cookie is set when visiting our site in order to recognise the user when  visiting a page of our advertising partners. Furthermore, user behaviour can be  analysed and then used for targeted product recommendations and interest-based  advertising. The data stored in the cookie is not combined with other personal  data to create user profiles. By using this website, you consent to the  processing of data about you by Google in the manner and for the purposes set  out above. The legal basis for the processing of your data is Art. 6 para. 1  sentence 1 lit. f GDPR.

2.3.4.3  Google  Conversion-Tracking
In the context of  Google AdWords we use the so-called conversion tracking. When you click on an  ad taken out by Google, a cookie is set for conversion tracking. Cookies are  small text files that the Internet browser places on the user's computer. These  cookies expire after 30 days and are not used to personally identify users. If  the user visits certain pages of this website and the cookie has not yet  expired, Google and ourselfes can recognise that the user has clicked on the ad  and has been redirected to this page.
Each Google AdWords  customer receives a different cookie. Cookies cannot be tracked through the  websites of AdWords customers. The information collected using the conversion  cookie is used to generate conversion statistics for AdWords customers who have  opted for conversion tracking. Customers see the total number of users who  clicked on their ad and were redirected to a page with a conversion tracking  tag. However, they will not receive any information that personally identifies  users. If you do not wish to participate in tracking, you can object to this  use by easily deactivating the Google Conversion Tracking cookie via your  Internet browser under User Settings. You will then not be included in the  conversion tracking statistics. Conversion cookies are stored on the basis of  Art. 6 para. 1 lit. f GDPR.

You can set your  browser so that you are informed about the setting of cookies and only allow  cookies in individual cases, to exclude the acceptance of cookies for specific  cases or in general, and to activate the automatic deletion of cookies when  closing the browser. When cookies are deactivated, the functionality of this  website may be limited.

2.3.4.4  Google reCAPTCHA
We use “Google  reCAPTCHA” (below referred to as “reCAPTCHA”) on our websites. The provider is  Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
With reCAPTCHA, it  should be checked whether the data entry on our websites (e.g. in a contact  form) is done by a human being or by an automated program. For this purpose  reCAPTCHA analyses the behaviour of the website visitor on the basis different  characteristics. This analysis starts automatically as soon as the website  visitor enters the website. For analysis reCAPTCHA evaluates various  information (e.g. IP address, time the website visitor stays on the website or  mouse movements made by the user). The data collected during the analysis is  forwarded to Google.
The reCAPTCHA analyses  run completely in the background. Visitors to the website are not informed that  an analysis is taking place. Data processing is carried out on the basis of  Art. 6 para. 1 lit. f DSGVO.

2.3.4.5  Facebook Remarketing / Retargeting
This website uses  remarketing tags, such as Facebook Pixel from the social network Facebook, 1601  South California Avenue, Palo Alto, CA 94304, USA. The remarketing tags  establish a direct connection between the Facebook server and the user's  browser when visiting our website. This will transmit to the Facebook server  which of our websites the user has visited with his IP address. This  information is available to us for use when displaying Facebook Ads. This  allows the effectiveness of Facebook advertisements to be evaluated for  statistical and market research purposes and future advertising measures to be  optimised. Facebook assigns this information to the user’s personal Facebook  account. We expressly point out that we are not aware of the content of the  transmitted data or its use by Facebook. The collected data is anonymous to us,  and we cannot draw any conclusions about the identity of the users. For more  information about Facebook's collection and use of the data, your rights and  ways to protect your privacy, please see Facebook's privacy policy at www.facebook.com/about/privacy/. If you do not want Facebook to associate the  collected information directly with your Facebook account, you can deactivate  the remarketing function “Custom Audiences” here. To  do this, you must be logged in to Facebook. The legal basis for the processing  of your data is Art. 6 para. 1 sentence 1 lit. f GDPR.
2.3.5  Social media plug-ins
Our website also uses  programs (plug-ins) from the following social networks:

Vimeo Inc. (555 West  18th Street, New York, New York 10011, USA).
 
The plug-ins are  indicated on our website by the logos of the respective companies or e.g. the  addition “Like” and/or “Recommend”. When you visit a website on our Internet  site that contains such a plug-in, your browser establishes a direct connection  to the servers of the respective company, which in turn transmits the content  of the plug-in to your browser and integrates it into the displayed website.  This will forward the information that you have visited our website to such  companies. We have no influence on the data collected and on data processing,  nor are we aware of the full extent of data collection, the purposes of processing  or the storage periods. We also have no information on the deletion of the data  collected by the plug-in provider. The plug-in provider stores the data  collected about you as user profiles and uses these for the purposes of  advertising, market research and/or demand-oriented design of its website. Such  an evaluation takes place in particular (also for users who are not logged in)  for the representation of advertisement tailored to suit a market need and in  order to inform other users of the social network about your activities on our  website. You have a right of objection to the creation of these user profiles,  and you need to contact the respective plug-in provider to exercise this right.  Through the plug-ins we offer you the possibility to interact with social  networks and other users, so that we can improve our offer and make it more  interesting for you as a user. If you are logged in to these companies  via your personal user account during your visit to our website, they can  assign the website visit to this account. By interacting with plug-ins, e.g. by  clicking the "Like" button or leaving a comment, this information is  transmitted directly to these companies and stored there.
If you visit one of our  pages equipped with a Vimeo plugin, a connection to the Vimeo servers is  established. The Vimeo server will be informed which of our pages you have  visited. Vimeo also obtains your IP address. This also applies if you are not  logged in to Vimeo or do not have an account with Vimeo. The information  collected by Vimeo is transmitted to the Vimeo server in the USA. If you are  logged in to your Vimeo account, you allow Vimeo to associate your surfing  behaviour directly with your personal profile. You can prevent this by logging  out of your Vimeo account.

2.3.6  Google Web Fonts
This site uses  so-called web fonts provided by Google to uniformly display fonts. When you  call up a page, your browser loads the required web fonts into your browser  cache to display texts and fonts correctly. To do this, the browser you are  using must connect to Google's servers. This gives Google knowledge that our  website has been accessed via your IP address. The use of Google Web Fonts is  in the interest of a uniform and appealing presentation of our online offers.  This represents a legitimate interest within the meaning of Art. 6 para. 1 lit.  f GDPR.

3. Individual  online services

3.1Contact  form

On our website we offer  you the possibility to contact us via a contact form to answer your individual  questions. In any case, we need your first and last name as well as your e-mail  address and information so that we can contact you. If you give us your  telephone number or address, we will gladly call you back to answer your  question or contact you in writing. The legal basis for the processing of your  data is Art. 6 para. 1 sentence 1 lit. b GDPR.

3.2 Request  information
On our website we offer  you the possibility to request information material about our products via a  form. In any case we need your first and last name, your postal address as well  as your e-mail address and a telephone number. The legal basis for the  processing of your data is Art. 6 para. 1 sentence 1 lit. b GDPR.

3.3 Newsletter
We enable you to stay  in contact with us via our newsletter. We use your title and your name to  address you personally in the newsletter and we use your e-mail address to send  you information on the topics you are interested in. The legal basis according  to Art. 6 para. 1 sentence 1 lit. a GDPR is your consent. To ensure that no  other person has registered you for the subscription of the newsletter and that  you do not receive any unsolicited e-mails, you will receive a confirmation  e-mail to the e-mail address you provided. To activate the subscription, click  on the link contained in the e-mail. After your confirmation we will save your  data for the purpose of sending you the newsletter (legal basis is Art. 6 para.  1 sentence 1 lit. a GDPR).
You can revoke your  consent to receive the newsletter at any time and unsubscribe from the  newsletter. You can declare your revocation by clicking on the link provided in  each newsletter e-mail or by sending an e-mail to info@tanos.de.
When using the  newsletter, the user behaviour is evaluated in an anonymous form without any  reference to a specific person being established. This includes:

  • Openings  (measured / invisible / total)
  • Clicks  and openings by terminal devices
  • Clicks,  openings and delivery over time
  • Bounces  (e-mail is undeliverable)
  • Cancellations.

3.4 TANOS idea  tool

You can use our TANOS  Idea Tool to submit your idea for the improvement of our products. You can use  our form to submit your idea. We need your contact details and the details of  your idea. The special provisions of the confidentiality declaration available  there shall apply. The legal basis for the processing of your data is Art. 6  para. 1 sentence 1 lit. b GDPR.

3.5 TANOS  media centre

We provide product  images and videos in our media centre. With the function “Recommend” we offer  you the possibility to send a link to the corresponding picture or video via  your own mail client.

3.6 TANOS  online shop

You can also purchase  our products directly from TANOS via our online shop. To do so, we need your  name (first and last name), your address and e-mail address as well as a  telephone number. We offer different options to pay for the ordered products.  Payment transactions via the usual means of payment (Visa/MasterCard, direct  debit) are made exclusively via an encrypted SSL or TLS connection. You can  recognise an encrypted connection by the fact that the address line of the  browser changes from “http://” to “https://” and by the lock symbol in your  browser line.
Depending on the type  of payment method you have chosen, we require information about your bank  details or credit card number. We transmit personal data to the bank  commissioned to process the payment. On our website we offer payment via  PayPal. The provider of this payment service is PayPal (Europe) S.à.r.l. et  Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter “PayPal”).  If you choose to pay via PayPal, your payment details will be sent to PayPal.  Data will only be transmitted to third parties if this is necessary in the  scope of contracted processing, for example to the companies entrusted with the  delivery of the goods. Your data will not be disclosed to third parties without  your express consent, for example for purposes of advertising.

3.7 TANOS  lettering tool

We offer you the possibility to individually label  plug-in cards for your Systainer and have them printed subsequently. To do so,  we need your name (first and last name), your address and e-mail address as  well as a telephone number, bank details or credit card number. We use a  service provider to process your order. The legal basis for the processing of  your data is Art. 6 para. 1 lit. b GDPR or Art. 6 para. 1 lit. a GDPR.

3.8 TANOS  dealer access

As a dealer you can  register and get access to further information about the products as well as  pictures and film material. For the registration we need your e-mail address.  You must also enter a password to ensure that only you have access. As a dealer  you will then be activated for access by TANOS. The legal basis for the  processing of your data is Art. 6 para. 1 lit. a GDPR.

4. Which  rights can you assert?

4.1 Right to object
         
  • You have the right to object to the processing of your personal data for direct marketing purposes at any time without giving reasons.
           
    Please address your objection in writing to Tanos GmbH, Pionierstraße 1, 89257 Illertissen, Germany or by e-mail to: info@tanos.de. The revocation of the given consent is possible at any time. You can use the link contained in the newsletter or send it to us in writing.
         
    When you unsubscribe from the newsletter, you can also remove individual newsletter topic areas under the “Newsletter” tab at any time, which corresponds to unsubscribing a newsletter. You will also find information on how to unsubscribe under each newsletter.
           
  • If we process your data to protect legitimate interests, you may object to such processing for reasons arising from your particular situation. We will then no longer process your personal data unless we can prove compelling reasons worthy of protection for the processing that outweigh your interests, rights and freedoms or if the processing serves to assert, exercise or defend legal claims.

We would like to draw  your attention to the fact that in order to enter into and process contractual  relationships, you must provide the personal and company-related data required  for the establishment, execution and termination of the contractual  relationship and the fulfilment of the associated contractual obligations or  which we are legally required to collect. 5.1 We take technical and organisational measures to  protect your data from unauthorised access, unintentional modification,  accidental loss or unlawful destruction. However, no electronic or physical  transmission and storage is absolutely secure. Any transmission is therefore at  your own risk.

5.2 In the context of  this Data Privacy Statement, we want to inform you as quickly and  comprehensibly as possible about the relevant topics. You will find additional  information for the respective purposes of processing your data as well as  explanations of the terms used by us on our website.
